About BidMeld

BidMeld is operated by BidMeld LLC. BidMeld provides software tools designed to help contractors discover, evaluate, organize, and respond to project opportunities and to help homeowners connect with contractors for project needs.

Acceptance of Terms

By creating an account, purchasing a subscription, or otherwise using BidMeld, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use BidMeld.

Eligibility

You must be at least 18 years old and legally able to enter into binding agreements to use BidMeld. If you use BidMeld on behalf of a company or other organization, you represent that you have authority to bind that organization to these terms.

Accounts

  • You are responsible for providing accurate account information and keeping it reasonably current.
  • You are responsible for safeguarding access to your account.
  • You may not impersonate another person or business or use an account you are not authorized to use.
  • You are responsible for activity conducted through your account, except to the extent caused by BidMeld's own failure to protect the service.

Contractor Accounts

  • Contractors are responsible for the accuracy of information provided about their company, capabilities, licenses, insurance, service areas, and other qualifications.
  • Unless BidMeld specifically states otherwise, BidMeld does not independently verify contractor licenses, insurance, bonding, certifications, or other credentials.
  • Contractors remain solely responsible for determining whether they are legally and commercially qualified to pursue or perform any project.
  • BidMeld does not guarantee that a contractor will receive, win, or profit from any opportunity displayed through the service.

Homeowner Accounts

  • Projects posted through BidMeld must be genuine requests relating to property you own or are authorized to represent.
  • You may not post fraudulent, misleading, unlawful, or deceptive project requests.
  • Homeowners are responsible for evaluating contractors, quotes, licenses, insurance, references, and qualifications before hiring.
  • BidMeld is not responsible for the quality, safety, legality, timing, or completion of work performed by a contractor.

Contractor and Homeowner Transactions

Unless expressly stated otherwise, BidMeld is not a general contractor, construction contractor, employer, agent, or party to agreements entered into between homeowners and contractors. Quotes, proposals, contracts, payments for construction work, warranties, and project obligations are between the applicable homeowner and contractor.

Paid Subscriptions

BidMeld may offer paid subscription plans, including BidMeld Business. The price, billing interval, and features included with a paid plan will be shown before you authorize the purchase.

BidMeld Business is offered with monthly or annual billing. Legacy BidMeld Pro subscriptions remain subject to the terms shown when they were purchased. Unless you cancel, your subscription automatically renews each billing cycle and the applicable subscription fee is charged through the payment method authorized through our payment provider.

Subscription prices may change in the future. Any price change will apply in accordance with applicable law and the terms presented to you.

Payment Processing

Paid BidMeld subscriptions may be processed by third-party payment providers, including PayPal. Your use of a payment provider is also subject to that provider's applicable terms, policies, and payment authorization requirements.

You authorize the applicable payment provider to process the recurring subscription charges disclosed to you when you subscribe.

Cancellation

You may cancel a PayPal BidMeld paid subscription from the Subscription section of your BidMeld Profile while logged into your contractor account.

Cancellation stops future recurring charges for the canceled subscription. Under BidMeld's current subscription system, Pro access ends when the payment provider confirms the cancellation.

Refunds

Unless required by applicable law or otherwise expressly stated by BidMeld, subscription charges that have already been processed are non-refundable and BidMeld does not automatically provide prorated refunds or credits for partially used billing periods.

Opportunity Data

Government procurement, contracting, award, and other opportunity data displayed through BidMeld may be collected or derived from public agencies, procurement platforms, and other third-party sources. BidMeld attempts to provide useful and timely information but does not guarantee that such information is accurate, complete, current, or suitable for a particular bid.

Deadlines, eligibility requirements, documents, amendments, instructions, and other solicitation details should always be verified directly with the issuing agency or official source before you rely on them or submit a bid or proposal.

Matching, Rankings, and Recommendations

BidMeld may rank, categorize, summarize, or recommend opportunities based on information in your profile and information obtained from opportunity sources. These features are intended to assist your evaluation and are not guarantees of eligibility, suitability, profitability, or award. You are responsible for independently reviewing each opportunity.

Third-Party Sources and Links

BidMeld may link to government agencies, procurement platforms, contractor websites, and other third-party services. BidMeld does not control those services and is not responsible for their availability, content, security, policies, or actions.

Prohibited Conduct

  • Do not use BidMeld to harass, defraud, deceive, threaten, or harm another person or business.
  • Do not attempt to gain unauthorized access to accounts, systems, or data.
  • Do not interfere with, overload, disrupt, or damage BidMeld's infrastructure.
  • Do not scrape, systematically extract, copy, resell, or redistribute BidMeld data or services except as expressly authorized by BidMeld.
  • Do not reverse-engineer or attempt to circumvent access controls, subscription limits, or security measures except where such restriction is prohibited by law.
  • Do not use BidMeld for unlawful activities.

Intellectual Property

BidMeld's software, branding, design, original content, organization, and proprietary features are owned by BidMeld LLC or its licensors and are protected by applicable intellectual property laws. These terms do not transfer ownership of BidMeld intellectual property to you.

Public procurement documents and third-party materials remain subject to the ownership, public records status, licenses, and rights applicable to those materials.

Service Availability

We may modify, improve, replace, suspend, or discontinue features of BidMeld from time to time. We do not guarantee uninterrupted or error-free operation, and temporary outages may occur because of maintenance, third-party services, infrastructure failures, or events outside our reasonable control.

Disclaimer of Warranties

To the maximum extent permitted by applicable law, BidMeld is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Limitation of Liability

To the maximum extent permitted by applicable law, BidMeld LLC and its owners, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, loss of profits, loss of business opportunity, loss of data, or similar losses arising from or relating to your use of BidMeld.

To the maximum extent permitted by applicable law, BidMeld LLC's aggregate liability arising from or relating to the service or these terms will not exceed the amount you paid directly to BidMeld for the service during the twelve months immediately preceding the event giving rise to the claim.

Termination and Suspension

We may suspend or terminate access to BidMeld if we reasonably believe an account has violated these terms, created risk for other users or BidMeld, engaged in fraud or unlawful activity, or misused the service.

You may stop using BidMeld at any time. Subscription cancellation and account deletion are separate actions. Canceling a subscription does not automatically delete your BidMeld account.

Changes to These Terms

We may update these terms as BidMeld evolves or as needed to reflect changes to the service, business, or applicable requirements. We will update the “Last updated” date when we make changes.

Where legally required, we will provide additional notice or obtain consent before material changes take effect. Continued use of BidMeld after updated terms become effective constitutes acceptance of those terms to the extent permitted by applicable law.

Governing Law

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable law requires otherwise.
